READ THESE INSTRUCTIONS CAREFULLY. IF YOU FAIL TO FOLLOW THESE INSTRUCTIONS, YOU MAY LOSE CERTAIN BENEFITS TO WHICH YOU MIGHT OTHERWISE BE ENTITLED.
- Summary of Key Provisions
Under this settlement, certain purchasers of Apple iTunes gift cards may be eligible for an iTunes Store credit if they meet the eligibility requirements described below.
Unless you request exclusion from the Class as explained in the Class Notice, you will be bound by the Settlement Agreement and Release and the Final Judgment even if you do not return the Claim Form.

- Who is Eligible to Make a Claim under the Settlement
To qualify, you must meet the following criteria:
(1) You must be a United States resident;
(2) You must have purchased or received an iTunes gift card where the card or packaging to which it was attached contained language that "songs are 99¢" or other language indicating that songs are priced at 99¢;
(3) You must swear/affirm that you did not believe any song you purchased using the card would cost more than 99¢;
AND
(4) You must have used that card to purchase one or more $1.29 songs from the iTunes Store on or before May 10, 2010.
- What Payments are Provided for under the Settlement
If you are eligible to make a claim under the settlement, you may be entitled to an iTunes Store Credit in the amount of $3.25.
You are limited to one iTunes Store credit.
- How to Make a Claim
To make a claim, you must fill out the form by clicking the "File a Claim Form" link. You will be provided with a copy of the completed Claim Form as a receipt for your records, but please remember that no paper Claim Forms will be accepted.
- Claims Deadline
You submit a completed online Claim Form via this website on or before September 24, 2012. If you fail to submit your Claim Form by the deadline, your claim will be rejected, and you will be deemed to have waived all rights to receive a payment under this settlement.
Remember: To be valid, your Claim Form must be completely and accurately filled out and must include all requested information. If your Claim Form is incomplete, untimely, or contains false information, it may be rejected by the Claims Administrator.
You will only be able to file once for each Apple ID you have, and you will not be able to correct an incomplete claim.
